Referring Experts to Your Clients

In the normal course of doing business as a commercial/industrial agent your clients will need to hire different experts and consultants as they continue to move towards completing a real estate transaction with you acting as their agent. However, if you refer your client to someone and that person's work on behalf of your client causes financial injury to your client, you could be held responsible by your client for that financial injury. In addition to this if your client decides to sue the person you referred them to they might possibly name you as an additional defendant to the lawsuit. And of course this is not any position you want to be in as an agent.

If you don't already have one, design a standard form that has your clients indemnify you against any claims for losses they may sustain from experts and consultants you may refer to them. Then have your company's attorney review and approve the form before you begin using it.

If you then have a client who refuses to sign this form your best decision may be to have him look in the Yellow Pages and find a consultant on his own.
